More Frienditto/Friendditto crap
Monday, March 7th, 2005 01:18 pmMany of you will have heard about this by now (because some of you will have received notices of your own), but I received a notice from LJ abuse stating that a complaint had been lodged indicating that I was using graphics to which someone else held the copyright. It referred to my post from yesterday that contained the anti-Frienditto graphics I made.
Let me just say, first of all, that the complaint is actually valid. Frienditto does have every right to claim the copyright to their logo.

Just like I claim the copyright to any original graphics I create, they can claim copyright to their logo. Such as it is.
However, there is the doctrine of Fair Use, which states (emphasis added by me):
I therefore submit that what I was doing constitutes "fair use."
However, I am not without feelings, and have come to pity these poor Frienditto.com/LJDrama.org/EncyclopediaDramatica.com fools. Therefore, I have made new, all original anti-Frienditto graphics for you to use! These images are completely original, and I have the files to prove it. They are ©2005 Jennifer Robertson, but I give permission for them to be used on Live Journal accounts by members who are against Frienditto.
Please don't hotlink - upload them to your own server or photo storage site. If Photobucket gives you trouble, you can refer them to this post. Or try http://www.maj.com as an alternative.

Of course, it really doesn't matter that much, because Frienditto is already in its death throes, IMO.

The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action in the Copyright Office is required to secure copyright.
Copyright is secured automatically when the work is created, and a work is "created" when it is fixed in a copy or phonorecord for the first time. "Copies" are material objects from which a work can be read or visually perceived either directly or with the aid of a machine or device, such as books, manuscripts, sheet music, film, videotape, or microfilm.
Just like I claim the copyright to any original graphics I create, they can claim copyright to their logo. Such as it is.
However, there is the doctrine of Fair Use, which states (emphasis added by me):
"...the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright."
I therefore submit that what I was doing constitutes "fair use."
